Prohibited Conduct
Misconduct for which students are subject to disciplinary action, up to and including suspension or expulsion from the University will generally fall into the following categories listed below as violations of the University Standards. These standards are separate from those prohibited under the University’s Sexual Harassment Grievance Procedure under Title IX.
Abuse: Physical abuse, verbal abuse, threats, intimidation, and/or any other conduct which threatens or endangers the health or safety of any person.
Abuse of the Student Conduct System: including but not limited to
a. Failure to obey the notice from a University official to appear for a meeting or hearing as part of the Student Conduct System.
b. Falsification, distortion, or misrepresentation of information during a Student Conduct Process.
c. Disruption or interference with the orderly conduct of a Student Conduct Process.
d. Institution of a Student Conduct Process proceeding in bad faith.
e. Attempting to discourage an individual’s proper participation in, or use of, the Student Conduct Process.
f. Attempting to influence the impartiality of a member of a Student Conduct Process prior to, and/or during the course of, the Student Conduct Process proceeding.
g. Harassment (verbal or physical) and/or intimidation of a member of a Student Conduct Process prior to, during, and/or after a student conduct code proceeding.
h. Failure to comply with the sanction(s) imposed under the Student Code.
i. Influencing or attempting to influence another person to commit an abuse of the Student Conduct Process.
Alcohol Violation: Violation of the University’s policy on alcohol (see the Alcohol Policy for further details).
Community Relations Violation: Linfield University is a part of the McMinnville and Portland communities; therefore, all students have an obligation to behave in a manner that creates good relationships with surrounding neighborhoods and/or neighbors. A student's behavior on and off campus is subject to Linfield University policies as well as any rules, regulations, and laws applicable to McMinnville and Portland. Furthermore, local police have jurisdiction on and off any Linfield University campus. Students approached by campus and/or local authorities must show identification upon request, be truthful, and comply with requests made by those acting within the scope of their authority while doing their duty.
Dishonesty in University Business: Acts of dishonesty, including but not limited to the following:
a. Cheating, plagiarism, facilitating academic dishonesty, or other forms of academic dishonesty (see Academic Integrity Policy).
b. Furnishing false information to any University official, faculty member, or office.
c. Forgery, alteration, or misuse of any University document, record, or instrument of identification.
Disorderly Conduct: Disorderly conduct (including that resulting from intoxication), unreasonable noise, or behavior that results in unreasonable annoyance. Disorderly Conduct also includes conduct that is lewd, or indecent; breach of peace; or aiding, abetting, or procuring another person to breach the peace on University premises or at functions sponsored by, or participated in by, the University or members of the academic community. Disorderly Conduct includes but is not limited to: Any unauthorized use of electronic or other devices to make an audio or video record of any person while on University premises without their prior knowledge, or without their effective consent when such a recording is likely to cause injury or distress. This includes, but is not limited to, surreptitiously taking pictures of another person in a space in which they have a reasonable expectation of privacy.
Disruption of University Processes: Intentional disruption, obstruction, or interference with the process of instruction, research, administration, student discipline, or any other service or activity provided or sponsored by the University, including its public service functions on or off campus, or of other authorized non- University activities when the conduct occurs on University premises.
Drug Violation: Violation of the University's policy on drugs or any illegal activities committed that involve controlled substances (see the Drug Policy for details).
Failure to Comply: Failure to comply with the direction of University or public officials acting in the performance of their duties in a timely manner (as perceived by the University or Public Officials) and/or failure to identify oneself to these persons when requested to do so.
Failure within Adjudication: Contempt of adjudicative proceedings, including impairing or interrupting the due course of proceedings of University hearing officers/bodies.
False Documents: Forgery or the alteration and/or unauthorized use of University documents, records, or forms.
False Information: Knowingly providing false information to University officials or officers of instruction or administration.
Harassment: Any violation of the Anti-Harassment Policy. This includes retaliation as defined in the Anti-Harassment Policy.
Hazing: Any violation of the Hazing Policy.
Interfering with the Rights of Others: Conduct which adversely affects the member’s suitability as a member of the University community or which interferes with the rights and privileges of another member of the University community.
Lewd or Indecent Behavior: Engaging in behavior can be seen as lewd or indecent to a reasonable person including, but not limited to, profanity, indecent exposure, lewd or obscene expressions, observing others without their consent in a private space, disrespectful and disruptive statements toward University personnel during the course of performing their job, public urination.
Misuse of Keys or ID: Unauthorized possession, use, or duplication of University keys or identification cards. Facilitating such use.
Property Destruction: Damage, destruction, theft, or unauthorized use of personal property located on the University campus or property owned or controlled by the University. Please see information on damage billing for residential students in Community Standards and Expectations.
Sales and Solicitation Violation: Linfield prohibits on-campus sales, in any form, of goods or services not contracted for or by the University, ASLU, or their officially recognized clubs and organizations. All authorized vendors must be registered and approved by the Director of Student Activities in McMinnville or the Student Life Office in Portland. No sales may be conducted door-to-door. Smoking, Vaping, Nicotine, and Tobacco Violation: Smoking (including e-cigarettes) and vaping is prohibited in all indoor areas of Linfield University, including but not limited to classrooms, hallways, lounges, laboratories, offices, dining areas, residence hall rooms, apartments, and all housing managed by Linfield University. Smoking and vaping is similarly prohibited at all indoor and outdoor public gatherings held on campus, regardless of the sponsor, in all University vehicles, and within 30 feet of building entrances or open windows on the McMinnville Campus. The Portland Campus is 100% tobacco free. Further information can be found in the Community Standards and Expectations.
Stalking: Engaging in a course of conduct directed at a specific person that would cause a reasonable person to (1) Fear for the person's safety or the safety of others; or (2) Suffer substantial emotional distress.
Tampering with Fire Safety: Tampering with fire-fighting equipment or alarms, turning in a false alarm, or engaging in other behavior that constitutes a significant fire hazard.
Theft: The attempted or actual theft of and/or damage to property of the University or property of a member of the University community or other personal or public property, on or off campus.
Threats or Intimidation: Threats, intimidation, bullying, coercion, or other conduct which threatens or endangers the health, safety, personal property or academic participation or success of any person.
Unauthorized Presence: Unauthorized entry into, presence in, or use of University property, including facilities, residence halls, equipment, or resources (including, for example, library materials or loaned electronics).
Uncivil Behavior based on Protected Category: Uncivil, disrespectful, or intolerant behavior based on race, color, age, religion, sex, sexual orientation, gender, national origin, or physical handicap or other disabling condition.
Violation of Law: Violation of any federal, state, or local law.
Violation of University Policy: Violation of the University’s Sexual Misconduct and Relationship Violence Policy, Hazing Policy, Residence Life Guide, academic policies, technology policies, or any other published University policy. Failure to comply with rules, regulations, or standards of conduct approved by the University, provided they have been published, distributed, or posted in such a manner as to furnish adequate notice to students.
Weapons and Dangerous Objects: Possession, use, or threatened use of firearms, ammunition, explosives (including fireworks), dangerous chemicals, or any other objects used as weapons on University property or at University-sponsored or supervised activities, even if the item is legally possessed. Prohibited Weapons are defined below.
